It does explain why Engler would prefer to claim that she was invited in though." Well I don’t think she could "tell" the USA anything at all, I do not think it works that way at all. Protocol is protocol. I asked what the procedure was and it is the same for one Special Rapporteur as it is for another. Her investigation was Item 12 (a) of the provisional agenda of the UN Commission on Human Rights. She was not going as a tourist. I will agree with you that she was in contact with individuals and organisations who were advising her with respect to breaches of the ICCPR and general state sanctioned pervasive sexual and other non sanctioned abuses against women. Here is the way it happened. "At the invitation of the Government of the United States of America, transmitted by letter dated 15 May 1998, the Special Rapporteur on violence against women, its causes and consequences visited Washington D.C. and the States of New York, Connecticut, New Jersey, Georgia, California, Michigan and Minnesota from 31 May to 18 June 1998 to study the issue of violence against women in the state and federal prisons in each of the states mentioned." Strictly speaking the UN "wanting" to investigate the USA is one thing, but telling the USA it is investigating without a formal invitation to do so is another matter entirely. As the US government was itself reporting pervasive institutionalised widespread sex abuse as the product of two major USDOJ inquiries into specific jurisdictions then I think we can safely say that the USA was not telling the UN that there was nothing at all to worry about. If we think back to the visit by Mr. Bacre Waly Ndiaye, he had a terrible time getting into the USA, if I recall correctly the Special Rapporteur on extrajudicial, summary or arbitrary executions had to wait years to get into the USA because an invitation was simply not forthcoming. He was not able to simply just turn up as you were previously suggesting. The Special Rapporteur on extrajudicial, summary or arbitrary executions visited the United States of America from 21 September to 8 October 1997. The visit took place following several requests by the Special Rapporteur to the United States Government for an invitation. By letter dated 23 September 1994, the Special Rapporteur inquired whether the Government of the United States would consider inviting him to carry out a visit. By letter dated 25 September 1995, the Special Rapporteur reiterated his request. By letter dated 2 September 1996, the Special Rapporteur expressed concern that no reply had yet been received to his previous communications of 1994 and 1995 and reiterated his interest in conducting a mission to the United States. The invitation to visit the country was given orally to the Special Rapporteur on 8 October 1996 during a meeting held in Geneva with representatives of the Permanent Mission of the United States. The invitation was confirmed in writing by letter dated 17 October 1996. The request for a visit to the United States was based on persistent reports suggesting that the guarantees and safeguards set forth in international instruments relating to fair trial procedures and specific restrictions on the death penalty were not being fully observed. So that would relate to persistent reports of state sanctioned sexual and other abuses against women in the USA. The report eventually stated unambiguously that state sanctioned abuses were widespread. It did not mince words. That is state sanctioned abuses. Other sexual abuses not promoted by officials were also widespread. There are reports of problems and the UN tries to ensure treaty and other compliances and at the same time it collects a body of evidence for the UN Commission on Human Rights. Other committees might want to have it as well. It might even be pursuant to a Commission resolution. In fact the Coomaraswamy report had the same procedure. "Report of the Special Rapporteur on violence against women, its causes and consequences, Ms. Radhika Coomaraswamy, in accordance with Commission on Human Rights resolution 1997/44 Report of the mission to the United States of America on the issue of violence against women in state and federal prisons" The special rapporteur was invited by the US Government and she found widespread sexual abuse.
