When the ICC was first introduced it was to only prosecute crimes that were brought up in the UN Security Council. The US supported the court under those conditions. Now instead of cases being referred to the court by the U.N. Security Council, an independent prosecutor will make those highly political decisions. Amazingly, the ICC purports to have jurisdiction over citizens of countries that do not participate in the court, an unprecedented expansion of international law. The US cannot support this because our U.S. Constitution protects us from this type of court. With considerable anti-American sentiment attending the creation of the court, the ICC could easily become a forum for trying U.S. military and national policy as criminal matters. The United States would be surrendering national sovereignty to an international body. The United States Senate has approved a Bush administration proposal whereby the USA would be entitled, under certain circumstances, to militarily invade the Netherlands. The law empowers US armed forces to invade if a US citizen is brought before the International Criminal Court. This was passed on June 12,2002.
